Would i be able to sue the housing authority if the doctors determin my doughters RSV and other respiroral?

respitoral problems are due to the mold in my carpet? Also i spoke with the manager and she said the carpet was NOT new when i moved in. I also have shampood my carpet and the mold will go away for a month or two but it comes back doubled the amount it started a couple spots and now it spread all through the living room and my baby is starting to crawl.Also ever since she has been born she has had respitoral and other health problems.

  1. I would ask for the complex to remove the carpet the mold is either in the padding underneath or is a leak from under the floor. Yes if they refuse to fix it then you can take action, or cut out of your lease and move for unhealthy invironment but talk to someone before taking drastic action.
  2. talk to the landlord to see if they will fix the mold problem, if you can not get it remedied with the housing then yea, i would say you have a case...other than that move for your childs health...
  3. fight it hard with everyone and if you can move get a good environmental lawyer and fight with all your might, to lawyers mold is gold on the payout scale, insurance companies find mold removal expensive and fight it = mold can be fatal
  4. hard to say when you deal with the housing authority... I have low income housing and we don't have carpet, but when something needs to be fix they are on it.. here where I live onces we ask for something to be fixed they have 30 days to get it done.. Most of the time it only takes 2 or 3 day's.. I would go into the office and tell them about the problem and as your doing that ask for another copy of you rights.. that might worry them into helping real fast...lol Take care!
