what rights does my disabled mother have in the housing authority against being evicted?
i was arrested for a crime that i havent been convicted yet of. but they served my mother a eviction notice for her to be out in 7 days.

- Are you authorized as a tenant? Occupancy is restricted. One would have to examine the living situation and events around the place as a whole for a clear answer.
- if its section 8...they are very strict...anyone in the household...does drugs, or commits a crime...out...no question about that...
- She can appeal it to the housing authority, if you were a tennant in the home but agree to move out they may allow her to stay.
- If you are staying with your mom and you are on her lease thats why they are evictioning her. Because it says anyone who is on the lease on housing get arrested will be kicked off the program. Especially now with everything thats going on they are reall cracking down on that. Plus just because you are not convicted yet dont mean that you wont be soon. I'm Sorry, but thats why.
- Not sure where you are from, but here in my jurisdiction we have several housing authority communities. The people that are allowed to stay at the communities are put through a thorough background check before they are allowed to live there. Once they move in, they are placed under strict guidelines as far as any criminal activity is concerned. They can be evicted for simply fraternizing with known criminals, which may be the case your family is in. In our housing areas, the residents do not have to give permission to have their residences searched or anything. If anything illegal, or illegal activity, is found, responsible or associated parties are charged, possibly jailed, evicted, then banned from entering any of the housing communities. If they are caught back there, then they are arrested and prosecuted for trespassing.
- If you are listed on the lease of that apartment, then I believe that she can be evicted. Go the the Fair Housing web-site and check it out. The laws are different for Fair Housing than they are for Tenants and Landlords. Good Luck and why did you get arrested?
