Does the STRONG smell of pot outside an apartment justify a a search by police w/o a warrant?
I have asked several ?'s about the illegal activity of one of my neighbors and the assumption is often made that I'm the one doing wrong! Don't be so quick to judge, please. Some of us are trying to protect ourselves!

- Absolutely. It is called 'Probable Cause'. The odor emitting from the apartment are an indicator that the occupants are in possession of illegal drugs/narcotics. Don't do the crime if you can't do the time.

- Jeez things must have changed. Last I worked, about 6 months ago, just a strong smell was not enough. It does allow the police a good reason (probable cause) to get a search warrant but unless there is imminent danger, like to a child in the apartment, it does not allow a warrant-less search. An apartment is a residence. A movable vehicle, a car or truck for example, is different, even if you live in it. No warrant would be needed if the officer could articulate why he believed there was contraband in the vehicle. Familiarity with the smell of cannabis would be enough.
