dj contract broken...can i get sued?

one week before a wedding i met with a disc jockey to write out a music contract. we agreed the set up was for 5PM and 7PM to 11PM was for the dance SO, the day comes, the reception started and NO DJ...it was 5:30 we noticed he wasnt set up he called @6:30 He said that his equiptment & cds were stolen and was about 10min away. He did not show up until 7:15pm he set up and played @8:15pm. the music was wrong and he didnt play any requested music...not even the first dance as hus & wife. he didnt talk to me @ all!!! By the time he started playing half our guests left. He continued until 920pm at the time we told him to leave and did not pay him for his time other then the $50 down payment Can he sue me for the money that i owe him for the hour he played eventhough it was the wrong music and he was late?

  1. Even if he wants to sue you for not paying him..he doesn't have a strong case. First of all in the contract he was suppose to set up at 6:30 and showed up way LATE. And another thing, he played the wrong songs. Seriously him claiming that someone stole his stuff was probably bullcrap.
  2. Legally he can sue you however, if he does that you can counter sue for breach of contract as soon as he showed up late... I doubt he will sue as I am sure he is completely humiliated by what happen and does not want anymore attention drawn to it and does not want anymore people to find out about it then already have...our industry as dj, coordinators, photographers etc, is 90% recommendations and word of mouth
  3. First of all, and most importantly, I hope you have a copy of that contract. And I hope that contract has the times, fees, and services clearly stated (what is supposed to happen at what time for what amount of money). Thank goodness you have written down the sequence of events because that is very important and you may need that information for the future (a court appearance). And you also need to keep in mind . . you asked him to leave at 920PM, he did not leave on his own. And my question to you is . . did this person come highly recommended or did you just hire a DJ that was available and/or the least expensive? A reputable DJ would not conduct his or her business this way. A reputable DJ would not come late. A reputable DJ would be organized and would not play the wrong music. A reputable DJ would act professionally because his or her future business is dependent upon what he did yesterday and today.   4. no he cannot sue you. he did not fufill his obligations to you which was to be there at 5:00pm and play the songs u discusssed. if his stuff was stolen he didnt think to call you and give u a heads up so you could try to find someone else last minute. i think this guy has some real balls showing up so darn late and playing the wrong music.
  5. He violated his terms of the contract. You don't owe that jerk a cent more than you already paid him.
  6. he can bring a case against you in court, however i doubt he would win. :P plus that would put the spot light on his bad business practices and he would lose more than what you owe him. only if he was dumb would he do it.
