What legal action on violators of do not call list can I take?
i am called daily by one company and I want to take legal action. I have been on dnc list for months...

- If you're on the national do not call list, you need to note the number that's calling you and go to the do not call website. There is a way to report violaters there.
- contact your states Attorney Generals Office there should be a mechanism in place to report such violations. I had to do that in Indiana and it worked.

- Call the company and ask to speak to the executive assistant. Tell them the problem. If that does not stop it call and ask for the executive assistant. Tell them that you tried getting thm to help you and they failed. Then demand to speak to the CEO. Tell the CEO that his employees are breaking the law in his name.
- If they call, even after you ask them not to, you have a valid lawsuit. Call a lawyer.
- Just because you are on the DNC list does not mean that nobody can call you. If you have a business relationship with them then they are allowed to call you, or if they work on behalf of someone you have a busniess relationship with. Also if you ever fill out those cards you see in stores about winning a free trip or membership once you put you name and number on that card you will get calls from whoever they sell those #s to.. I used to work for a place who sold privacy assist for Bank of America and if you had a Bank of America account we could call you. So many times people said they would press charges but legally they couldnt because they had a busniess relationship with us through Bank of america.....I know its annoying ( thats why I was so excited when I changed jobs!!!! ) but in order to be able to have a case against them I would check and see who they are calling on behalf of and if its someone that you are associated with ( even if you just purchased something from them ) they technically have all legal rights to call you.
- Good answers above. I just wanted to point out that the do not call list does not apply to companies with whom you have a previous relationship, i.e. you've ever bought something from them.
- Have you done any business with them in the last 18 months or requested any information from them in the last 3 months? If so, they are allowed to call you. https://www.donotcall.gov/faq/faqbusiness.aspx : "A telemarketer or seller may call a consumer with whom it has an established business relationship for up to 18 months after the consumer's last purchase, delivery, or payment - even if the consumer's number is on the National Do Not Call Registry. In addition, a company may call a consumer for up to three months after the consumer makes an inquiry or submits an application to the company. And if a consumer has given a company written permission, the company may call even if the consumer's number is on the National Do Not Call Registry." It also does not apply to political organization, charities, or phone surveys. If you still feel they have violated the law, you can file a complaint with the FTC at https://www.donotcall.gov/complaint/complaintcheck.aspx. They will review the complaint and determine if the company did violate, and if so, they will fine them.
- If its a telemarketer, then you can report them on the DNC website. If its a business, like a credit card company, or a debt collector, they don't play by the DNC rules. Also, some charities, like the local police asking for donations, they don't fall under the DNC either. You can ask the person to stop calling you. If its a debt collector, they will stop, but they will want their money too.
