Is it safe to sell a modded xbox with priated games on craigslist?

Will I get caught or charged with something? I sold other stuff on craigslist before but I dunno about this one. Help me!

1. I don't have access to craigslist but try searching for something similar to what you're trying to sell (modded consoles). I believe pirated games might get you in trouble, though.
