- It's strictly a question of what the lease provides. If the restriction applies, you're out of luck.
- You signed the lease knowing that you couldn't have that dog. They are within their rights to evict you if you don't get rid of the dog.
- a lab would be over 20 pounds if not a puppy. if you signed the lease, you knew the rules. either lose the dog or find another place to live.
- If this was a new rule added to the lease, it was probably put there because of problems with dogs. Large dogs in an apartment are always a problem. It's hardly an abuse of power. It's probably in reponse to the complaints from other residents. When you signed that lease, YOU knew that you dog was more than 20 lbs. You should have either gotten rid of the dog or moved. You've lived there almost 6 months in violation of the lease. There must have been some incident with you or your dog that caused the notice.
- You should have read the lease prior to signing it. Which means you read the pet clause. Which means you knew that you were in conflict with the lease. Unfortunately, your out of luck. Either, get rid of dog or expect to be evicted.
- Actually if the dog has lived in the apartment for 9 years, then it may be 'grandfathered' under the lease you signed 9 years ago. Presumably they had 9 years for you to get rid of the dog, and didn't make any effort to do so, so you could argue implicit consent. In any case, see if you can get a lawyer to help you out with this, it's not something you can argue easily on your own, and you bet they have a lawyer on call.
