Do police need a warrant to search a rented apartment?

Now I know police need a warrant or significant probable cause to be able to search a person's home. But I would think that they wouldn't need a warrant to search someone's apartment if they are a renter as long as they have permission from the landlord to do so. So do police need a warrant to search an apartment or just permission from a landlord?

  3. They need a warrant or the tenant's consent, pure and simple. A parole officer does not need a warrant to check a parolee's home. But everyone else in law enforcement does.

  6. In Texas they have to have a warrant. That being said it does not really matter. They are the police and will lie and say that they smelled something or heard something so that gave them probable cause. The police will do what ever they want to. Even murder you.
  7. No, just because there is permission from the landlord does NOT mean the police can search a residence. Even a renter of a *room* in a house can not have their room searched unless the police can articulate that the room is a common area. This may be surprising, but if a child's room is not accessible to the parents, the parents can not even give permission to search the room. Therefore, to answer your question, a landlord cannot give permission. Search and seizure laws can be very confusing, but this is cut and dry - no.
