Action against USPS for identity theft?
Hi All, I need some advice. A disability check was delivered to the wrong address by USPS. Along with the check important details like SSN, and employment details were also compromised by delivery to the wrong address. I'm furious that such a mistake was made which opens a lots of possibilities for identity theft. The address on the mail was computer printed(not hand written) so there no chance for misinterpretation. Also the mail was delivered to an address which has absolutely no similarity to mine. I want to know if any action can be taken against USPS for such a costly mistake Thanks M

- Government is immune from such a lawsuit. Maybe not fair but that's how it is.
- The US Postal Service processes millions of mail pieces per day. Mis-delivery happens... You agree to the terms of service when you have your mail delivered, and it states that you cannot sue the USPS for delivery errors (beyond the cost of postage stamp). If you are concerned about identity theft, get a free copy of your credit report and subscribe to credit report monitoring.
- Disability check? Get back to work. Have you ever heard of "direct deposit?" Seriously, though, you'd have to prove the check was misdelivered, and prove that the people living at the misdelivery compromised your identity. Two very difficult things to prove. Had you moved recently? Did you place a change of address on file with the Post Office? Did your check come printed with your correct address, or an old address, in which it had to be forwarded? Can you prove the check was mailed? Can you prove it simply wasn't shredded in the Post Offices high speed mail processing equipment? these machines process something like 600 letters a minute...looking only at barcodes and zip codes, and the envelopes with the little view windows, notoriously become caught in the machines. Any action to be taken? You'd have to prove you suffered damages...an extremely difficult thing to prove based on your story.
