Will the employment security commission deny my weekly benefits.....?
.....if I cash out a 401k? For example, if I got a pay out of $1000, will the ESC deny me unemployment benefits for 5 weeks, since I draw $215/wk? This is a question they ask online or on the phone when you file your weekly certification.

- They will deny you benefits if you have any income. But I don't know how cashing out a 401k is considered income, since you already have it. I cashed mine out when on unemployment last year, just didn't tell them, they didn't ask. There is no way for them to know anyways, your savings are none of their business.
- the 401k is already your money so transferring it is NOT income. It's really only EARNED income that matters, unemployment-wise.
