Help! What do I need to do to save my status as a claimant for Unemployment Benefits?
Okay here's the deal: On July 2, 2009 I was discharged from an assignment that the staffing agency placed me in. I was not directly told until I left work that day when I received a call from the staffing agent. It was not for Misconduct or substantial fault connected with the work. The Rep at the job site felt things were not working out and asked the staffing company to discharge me from the assignment. Now this staffing company is filing an appeal to the Employment Security Commission. But according to the Commission, I cannot be denied benefits unless I was discharged for Misconduct or Substantial fault connected with the work. Why is this wound trying to get opened up again? I am a good person who is honest and responsible and I have been trying effortlessly to find work and failing miserably for the past 5 months. I also have been following the proper procedures in the Benefits processes. Why does this have to happen to me?

- In some states you can only claim unemployment if you've worked at the organization for at least 90-days. Otherwise the claim will be bounced to the prior employer. You may be trying to claim from the wrong organization.
- Sadly, I can't offer any concrete advice regarding this topic as it seems it varies from State to State PLUS the Unemployment Commission usually favors employers over any claims by past employees, regardless of the situation. Hang in there best you can. Honestly, its best to try and get ANY type of job you can right now, even if it is something like a cleaning job or working in a restaurant or whatever you may now want to do. Its better than trying to wait for Unemployment benefits that may not come through for you. 5 months is quite some time to be without work. I wish you luck and prayers are with you.
- Just tell the truth. That's the only good thing you can do. The Truth is always the honest way. Present all the evidence of your status and tell the Appeals Referee the facts. The ESC should have documentation to why you were discharged and I know you were truthful with them. If that is the whole truth and the ESC determines that you won't be disqualified for benefits, then you should be safe. The worst that can happen is that the employer actually claims that you were discharged for misconduct or substantial fault & you won't get benefits. It won't mean it's the end of the world. If that happens, be ready for a plan to find a job ahead of time just in case this arises. I'm sure you don't like hearing this because you already hated working in retail before but try looking for a job, even if it is at a store or something, just to have for some income after you don't receive benefits. Who knows, you might find a crappy job that isn't so bad after all. I would recommend Food Lion, it's not as hard or crazy as Target was. You might even like it. Hang in there, things will turn around for you. You are living at home, you don't pay rent or a mortgage. Just hang in there. I've been canned before and couldn't find work in the same field before. That's why I'm at a warehouse now.
