co-worker harassment laws?
I work in WA State and a fellow co-worker has not only called me vulgar names, but has talked badly about me to other worker's. Other than quitting (I need my job) what kind of leg do I stand on to get her removed legally? I have already contacted Employment Security, L&I and the Human Rights Commission with no better understanding of what I can do. These organizations really protect under "Discrimination". I have told my owner and manager both verbally and in an e-mail. They basically said that we are both valuable to the company and choose to do nothing. I even asked to be laid off in order to resolve the issue, but my boss told me no. She said that we would have to learn to play well together, but to be honest, I am not the one who is unable to act professionally, she is.

- Have you talked to your manager/boss. Ask your boss and have him tell you what he guidelines are. If its a big company they usually have a hotline or something.
- the definition of harassment is not exactly cut and dried. If the harassment you are experiencing is sexual in nature, it is very easy. If it is however merely rude and crass behavior, that is not necessarily prohibited by law. Your best course of action is to firmly tell your supervisor and owner, that the current situation is untenable. Inform them that either the other employee be formally reprimanded, and the behavior stop, or you will make a formal complaint to the state attorney general's office. Do not ask to be laid off agai, and do not let that be an option. The owner should be aware that responding to a harassment claim involves hours and hours paperwork to be filed with the state, as well as potentially having hours of lost productivity dealing with an investigator.
