My landlord sold my current apartment at a foreclosure sale, Are we getting kicked out?

Ive signed into a 1 year lease of an apartment in Boston, and just learned that there is a new owner. The previous owner went into foreclosure and the unit was sold at an auction. I was under the impression that I would be safe and have an apartment for 12 months, but I heard from some sources that the foreclosure terminates the lease and we will become tenants at will. If i am forced to leave in 30 days, who is going to help with the moving costs? the finders fee of my new apartment? is there anyone who is responsible for our expenses and inconvenience? no one notified us about this!

  1. Yep, unfortunately, your lease is not any good. I have the same problem and found out that I have to move too. I haven't gotten my notice yet though.

  3. You can sue your landlord. Of course, if the house is in foreclosure, its a good indication that you won't get anything and probably spend a lot of money on lawyers for nothing. You might be able to force a bankruptcy. Wouldn't THAT be fun!? The only way you could prevent this would depend on the agreement between the landlord and the financier over the mortgage. For better or for worse, the financier is at least tangentially involved with any business arrangements that the primary owner makes with the property - the nature of that relationship is spelled out in grueling detail in the mortgage arrangement which you won't have easy access to. You MIGHT be able to sue the financier as well. I doubt it - but you might. Do you have a family lawyer?
  4. NO! Nobody can kick you out. NO, the foreclosure does not void your lease. The new owner is required to honor your lease. EDIT: You have no legal grounds to sue anybody. The landlord was not legally required to tell you anything about foreclosure unless it is already filed at the time you sign the lease. This is basically THEIR personal finances and legally has nothing to do with you.
