Can he still charge sales tax?

So i was looking threw the classifieds on out local news web site, and i found a gut who is selling a lot of furniture, one of the sectionals i really like. i called him and asked to see and i asked why he had so many ads up, he said that he as going to open up a furniture store but things got really tough fro him so he wasn't able to open the store but he has already bought the inventory. anyway my question is can he charge me sales tax on something he is selling, it is not being sold threw a business? here is the link if you want to take a look at it http://www.ksl.com/index.php?nid=218&ad=5936423&cat=43&lpid=11 Thank you. so i should really proof read before i hit post here is what it should say: So i was looking threw the classifieds on our local news web site, and I found a guy who is selling a lot of furniture, I really like one of the sectionals.   1. If you're curious ask to see his state Dept. of Revenue Tax ID number. If he doesn't have one he didn't register with the state and won't be paying those "taxes" to them. If he has a Tax ID number (for the business!) then he can make you pay.
  2. Well just because he never opened the store, doesn't mean he doesn't have a tax ID. Which would mean to stay legal, he would have to charge taxes, and report everything he sells as income on his next return. Like I said, just because he never bought a building, or never had an actual location, doesn't mean he is exempt from taxes. As they say, the only two things in life we HAVE to do, is pay taxes and die..
  3. Yes he can. many businesses sell from home. I had a home business and had to charge and report sales tax. Even if he did not charge you sales tax, you are required to pay the tax to the state.
  4. It seems as if you are liable to such tax. If you don't pay the buyer you have to pay the State. he may have filed his paperwork to collect sales tax.
  5. just because he is not selling out of a storefront, doesn;t mean he is not a business - even people at flea markets and such are supposed to charge sales tax - you have to pay the tax -he IS a legit business in the eyes of teh law
