My Housing Authority is threating me with eviction due to the number of dogs I have?
Today I got a knock on my door with some lackey saying that im going to get kicked out of my home if I dont get rid of 1 of my 2 dogs.when in fact I know that there are 8 families living in my housing development with more than 2 pets.what legal action can I take to wave the eviction and do they have the authority to search my premises

- Housing authority..guess you are section 8 ? yes, they do have the right to inspect the property and to force you to get rid of one of the two dogs depending on their pet policy. You can't waive the eviction but you can try to fight it in court. I suggest you get proof that others have 2 dogs...real hard proof.
- The fact that other people have two dogs is not a defense. "Everyone is doing it" is NEVER a defense.

- Obviously your pets are causing a concern for the property owner.If they want you to lose a pet you have to.You are granted the right to live in a home for a reduced rate,you must follow the rules.If you do not comply they have every legal incentive to evict you.
- Read the lease you signed when you moved in. That will tell you how many if any dogs you can have. Yes they do have the authority to check your apartment if you are in subsidized housing. Follow the rules or they will evict you.
- It doesn't matter if your neighbor has 70 dogs in his place, all that matters is how many dogs you have. If the rules for your place state that you can only have 1 dog, and you have more than 1 dog, then you can get rid of as many dogs as you need to in order to get to that 1 dog limit, or you can be evicted. If your lease/housing agreement says that there is a 1 dog limit and you signed it then you're pretty much stuck. The amount of dogs in the other dwellings is so irrelevant that it almost hurts and has no bearing on your eviction.
- if it is against their rules then you cant do it. Pointing your finger and saying "but they do the same thing" is not a reason to break the rules
- Wow, some lackey? How about some respect? How about you get free stuff so maybe you have to follow rules? How do you have money for legal action? How do you know they all didn't get eviction notices also? Be an adult and not a victim.
- The only legal action you could take woudl be to get rid of the dogs. They, as well as the landlord if you are sectio8 and not in a project) have every right to search the premises, it is NOT YOURS.
