What is the punishment for illegally receiving unemployment?
There is a man that I know who has been on unemployment for two years now. From what I understand, you must at least submit a few applications every week to prove that you are actively seeking employment. He however, in the last year has only submitted 2 applications, And every week online fills in everything so that he will receive his money on his card on mondays. This is not right and I know for a fact that he works as an umpire and doesn't claim that as income. This man skirts around every law known to man and I believe its time someone said something and make him own up to his lies/theft or whatever you want to call it. Its not that he can't find work, he wont try to find any. What I want to know is what kind of punishment would/could he receive should someone put a bug in the employment security commission's ear? Its not fair to those who really need the benefits and can't get them because of people like him. I lived with him and saw what he filled out but at the time I was underage and couldnt do anything about it. I am not being vindictive I am just trying to do what is right

- Repayment generally. Also how do you know what he fills out for his UI forms? Or whether or not he spends an hour or 2 on monster/dice each day looking for work. Sounds like you are making a lot of assumptions. And I'll be honest with you, mption is pretty tired of it.
- He makes a little money umpiring and you know how many applications he submits.? Just worry about your own life and leave him alone. I would bet there is some other vindictive reason that makes you want to get him.
- If he is saying he looked for work and he didn't, that is fraud. If he is working under the table and still receiving benefits, that is fraud. However, I wonder how you are so intimately aware of his work search, and whether or not he submits applications. That being said, first of all, he would have to pay back all fraudulent benefits received. There are state-specific penalties for UI fraud. Also his employer can get in trouble. But you should know that his fraud is not preventing someone else from receiving UI benefits. And perhaps a bit of MYOB might be in order.
- He would be required to pay back any benefits unlawfully received and would be barred from receiving benefits for some period of time, possibly forever. Prosecution for fraud is possible but unlikely. If he has unreported income the Infernal Revenuers might be interested too. You know this guy is going to want to kill you, right?
- When receiving unemployment illegaly they may either make you pay them back all the money that you recieved fraudlently, disqualify for unemployment assistance in the future, or you can even go to prison.
- The benefits that he received unlawfully would need to be returned to patch things up with the unemployment office itself. However, when the company that holds the account with the unemployment office finds out that he has been fraudulently claiming benefits, they may seek further action against the former employee depending on how much they were charged for the benefits being processed from their account.
